Trump’s Prison Shake-Up: Transgender Women Banned from Federal Female Facilities

On his first day in office, U.S. President Donald Trump signed an executive order banning the placement of transgender women in federal women’s prisons. The directive, titled “Protecting Women from Gender Ideology Extremism and Restoring Biological Truth in the Federal Government,” mandates that inmates must be housed according to their sex assigned at birth.

This action reverses a policy, reinstated by Joe Biden, from the Obama era that allowed placement based on gender identity, intended to reduce violence against trans inmates. However, the previous practice faced heavy criticism and included reported cases of biological males committing violent crimes, such as the 2022 rape of a female inmate by a trans woman at Rikers Island.

Federal Bureau of Prisons data indicates a disproportionately high number: 15% of inmates (1,538 out of 10,047) in federal women’s prisons are biological males.

The order also bans the use of federal funds for gender-transition related medical treatments for inmates, stating that taxpayer money should not be spent on procedures aimed at “conforming an inmate’s appearance to that of the opposite sex.”

While conservative groups like the Independent Women’s Forum (IWF) applaud the move as restoring safety for women, numerous LGBTQ-advocacy organisations are challenging the order in court, arguing that denying appropriate housing and gender-related healthcare violates the Eighth Amendment against cruel and unusual punishment.
